                On June 12th, 2015 at approximately 1:00PM , I was located at 213316 E Finley Rd, commonly known as the Finley boat launch at Two Rivers Park at Kennewick, Benton County, Washington  (GPS location coordinates  46°11’04.4″N 119°02’00.8″W) when two men, while purporting to be Washington State Fish and Wildlife Officers, arrested myself without a warrant and administered my private property without any rights to do so, without probable cause or suspicion of a crime being committed,  and also while refusing to identify themselves and acting under color of state law  This state actor, Officer Chad McGary acted in concert with Sgt. Brian Fulton to violate my reasonable expectation of privacy and security, and violated clearly established law and objective reasonableness and also acted unreasonable by placing my person in restraints and delivering me to a jail where I would remain wrongfully imprisoned for more than 72 hours. The entire arrest was filmed by a professional film crew, taping an episode of “Rugged Justice” which later aired on September 27th 2015 with heavily edited footage to further severely and permanently damage my reputation and credibility by portraying myself to be mentally unstable.

Ofc. Chad McGary and Sgt. Brian Fulton are responsible in both private and commercial capacities for the wrongful imprisonment of myself, and all further loss and injury that followed as a result of the actions of Chad McGary while acting in concert with his supervisor Sgt. Brian Fulton under color of state law to falsely arrest and imprison myself without my having committed a crime, and without a warrant or probable cause for an arrest.

At this time, I am seeking just compensation for the violation of my secured liberties, having been falsely arrested, imprisoned, kidnapped, and having my property stolen and loss of my freedom and the harm, injury, and loss caused to my reputation and credibility; I am seeking said compensation from the following individuals:

  1. Chad McGary, one hundred and fifty thousand dollars ($150,000)
  2. Brian Fulton, one hundred thousand dollars ($100,000)

You are hereby notified that I expect payment within 60 days from the date of this notice; if you wish to contact me to negotiate a settlement, I will consider all offers. However, failure to pay or negotiate a settlement I will be forced to defend against you and those acting in concert with you in personam and in rem in a court of record against all named individuals and seek additional much higher damages. After 60 days from the date that you receive this notice, I plan on filing suit in order to seek declaratory and/or injunctive relief along with other applicable damages, including fees described in USC title 42 section 1988.

I am giving you this opportunity to settle gracefully for the irreparable harm and injury that you have caused myself, my family and my daughter. The fact that you are all public servants amenable to the people at all times and you have all signed oaths to uphold the Constitutions of both the State of Washington and the U.S. Constitution, you all should know better than to violate a person’s secured liberties.

Govern yourselves accordingly, and remember the 4th amendment to the US Constitution which  states “[t]he right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no Warrants shall issue, but upon probable cause, supported by Oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized.”.
